{"id":4518,"date":"2016-11-18T09:49:15","date_gmt":"2016-11-18T14:49:15","guid":{"rendered":"http:\/\/wp.umpi.edu\/utimes\/?p=4518"},"modified":"2025-08-23T16:12:44","modified_gmt":"2025-08-23T20:12:44","slug":"marijuana-in-maine","status":"publish","type":"post","link":"https:\/\/wp.umpi.edu\/utimes\/2016\/11\/18\/marijuana-in-maine\/","title":{"rendered":"Marijuana In Maine"},"content":{"rendered":"<p><a href=\"https:\/\/wp.umpi.edu\/utimes\/wp-content\/uploads\/sites\/27\/2016\/11\/Yes1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-4519\" src=\"https:\/\/wp.umpi.edu\/utimes\/wp-content\/uploads\/sites\/27\/2016\/11\/Yes1.jpg\" alt=\"yes1\" width=\"755\" height=\"412\" srcset=\"https:\/\/wp.umpi.edu\/utimes\/wp-content\/uploads\/sites\/29\/2016\/11\/Yes1.jpg 755w, https:\/\/wp.umpi.edu\/utimes\/wp-content\/uploads\/sites\/29\/2016\/11\/Yes1-300x164.jpg 300w\" sizes=\"auto, (max-width: 755px) 100vw, 755px\" \/><\/a><\/p>\n<p>On Nov. 8, 2016, Voter Question 1 passed 372,995 (50.15%) to 370,820 (49.85%) and marijuana became much more available in Maine beginning Jan. 1, 2018.<br \/>\n<!--more--><\/p>\n<p>Citizen\u2019s Initiative 1 read: Do you want to allow the possession and use of marijuana under state law by persons who are at least 21 years of age, and allow the cultivation, manufacture, distribution, testing, and sale of marijuana and marijuana products subject to state regulation, taxation and local ordinance?<\/p>\n<p>What does this mean for the citizens of Maine?\u00a0 First, marijuana will not necessarily be available for purchase everywhere.\u00a0 The ballet question gives each municipality the ability to regulate retail marijuana establishments and retail marijuana social clubs. \u00a0All towns will have the ability to decide whether to permit the sale or use of marijuana in their town limits.\u00a0\u00a0 The new law also permits the registered voters of a municipality to call for a vote on any regulations adopted by a municipal legislative body.<\/p>\n<p>Most of the towns in northern Maine voted against this initiative, so it is uncertain if these towns will permit the sale of marijuana.\u00a0 We will have to wait and see.<\/p>\n<p>How will this affect the rules and policies at the University of Maine at Presque Isle?\u00a0 The quick answer is that it will not change the rules or policies on any of the state\u2019s community colleges or universities.<\/p>\n<p>The logical question to ask is why?<\/p>\n<p>Federal criminal law and the federal Drug Free Schools and Workplaces Acts make possession or use of marijuana on campus illegal. When a federal law and a state law seek to regulate the same subject matter, the federal law always supersedes the state law.
